1. Investigative Services
Blue Dog Investigations provides private investigative and related services subject to applicable law, licensing requirements, professional standards, client authorization, and contractual terms.
The availability and legality of an investigative method may vary according to the facts, jurisdiction, ownership interests, consent, purpose, location, and other circumstances.
2. Right to Decline or Terminate Assignments
Blue Dog Investigations reserves the right, subject to applicable law and contractual obligations, to decline, suspend, restrict, or terminate an investigation when we reasonably believe:
The requested activity may be unlawful;
The client has materially misrepresented the purpose of the investigation;
Material information has been withheld;
The assignment creates an unacceptable safety risk;
A conflict exists;
Continued work may violate licensing or professional requirements;
Required fees or retainers have not been paid; or
Continued performance would otherwise be inappropriate under the governing agreement.
3. Client Certification
Clients are responsible for accurately identifying themselves and truthfully describing the purpose of requested investigative services.
Blue Dog Investigations may rely upon those representations when determining whether to accept an assignment.
A client may not knowingly use Blue Dog Investigations to facilitate stalking, harassment, intimidation, unlawful discrimination, unauthorized access, unlawful surveillance, identity theft, fraud, or another illegal purpose.
4. No Guaranteed Outcome
Investigative fees compensate Blue Dog Investigations for professional time, expertise, resources, and authorized services—not for a guaranteed result.
The absence of useful activity or evidence during surveillance or research does not establish that professional services were not properly performed.
5. Surveillance
Surveillance is affected by circumstances outside our control, including subject activity, traffic, weather, visibility, access, private-property restrictions, law enforcement activity, safety, vehicle conditions, environmental circumstances, and counter-surveillance behavior.
Continuous visual contact cannot be guaranteed.
Investigators may discontinue or modify surveillance when necessary for safety, legality, operational integrity, or avoidance of unreasonable detection.
6. Research and Database Information
Public records, proprietary databases, commercial databases, social-media sources, and third-party records may contain errors, omissions, delays, aliases, outdated information, or mismatched records.
Blue Dog Investigations endeavors to evaluate information professionally but cannot warrant the accuracy of information maintained by independent third parties.
7. Background Investigations
Background investigations are performed only for permissible and lawful purposes.
Employment, tenant, credit, insurance, and other eligibility-related screening may be regulated by federal or state consumer-reporting or privacy laws and may require specialized procedures, certifications, notices, consent, adverse-action procedures, or appropriately qualified third-party providers.
No Website representation should be interpreted to mean that every background-search service is available for every purpose.
8. Social Media and Online Investigations
Online and social-media investigations are limited to methods Blue Dog Investigations determines to be legally and professionally permissible.
Blue Dog Investigations does not authorize unlawful hacking, password theft, credential compromise, malware, unauthorized account access, unlawful impersonation, or unlawful interception of electronic communications.
9. Recording and Tracking Technologies
Audio recording, electronic monitoring, tracking technology, GPS devices, drones, cameras, and similar technologies may be subject to specific federal, state, local, property, aviation, privacy, consent, or other requirements.
A client's request does not determine whether a technique is lawful.
Blue Dog Investigations retains professional discretion regarding whether and how a requested investigative technique may lawfully be used.
10. Drone Operations
Any drone services undertaken by Blue Dog Investigations are subject to applicable aviation rules, airspace restrictions, weather, safety conditions, property rights, privacy considerations, and operational requirements.
Availability of drone services is not guaranteed for every location or assignment.
11. Evidence and Court Proceedings
Blue Dog Investigations endeavors to collect and document information professionally and accurately.
However, no representation is made that any particular photograph, recording, report, document, statement, observation, or other information will be admitted into evidence or assigned any particular weight by a court, attorney, insurer, governmental agency, arbitrator, or other decision-maker.
Questions concerning admissibility and legal strategy should be determined by qualified legal counsel.
12. Attorney and Litigation Support
Investigators may work with attorneys and law firms in support of litigation.
Whether investigative materials qualify for attorney-client privilege, attorney work-product protection, or another legal protection depends upon applicable law and circumstances.
Blue Dog Investigations does not independently guarantee privileged status.
13. Reports
Investigative reports document relevant activities, observations, research, information, and findings within the authorized scope of work.
Unless expressly stated otherwise, investigative findings are not legal conclusions and should not be interpreted as guarantees regarding liability, guilt, innocence, coverage, damages, credibility, or the ultimate resolution of a dispute.
14. Client Use of Investigative Information
Investigative information and reports are provided for the lawful purpose associated with the engagement.
Clients are responsible for obtaining appropriate legal advice regarding subsequent use, publication, dissemination, employment decisions, legal proceedings, insurance decisions, or other actions based upon investigative information.
Blue Dog Investigations is not responsible for a client's independent unlawful misuse, alteration, misrepresentation, or unauthorized distribution of investigative information.
15. Confidentiality
Blue Dog Investigations endeavors to maintain client and investigative information in accordance with applicable agreements, laws, and professional requirements.
Confidentiality may be subject to lawful exceptions, including court orders, subpoenas, warrants, governmental requirements, licensing obligations, defense of legal claims, or other circumstances permitted or required by law.
16. Cooperation With Lawful Authority
Nothing in an investigative engagement requires Blue Dog Investigations to conceal criminal activity, destroy evidence, provide false information, obstruct justice, violate a lawful court order, or engage in conduct prohibited by law.
17. Fees and Expenses
Unless otherwise provided by an executed agreement, investigative fees represent payment for professional services and resources expended rather than payment contingent upon a particular investigative result.
Specific rates, retainers, minimums, mileage, travel expenses, third-party expenses, cancellation provisions, court appearances, rush services, and other charges may be governed by the applicable engagement agreement.
18. Scope of Services
Blue Dog Investigations is responsible only for services within the scope of an accepted engagement.
A client should not assume that an investigator is monitoring, preserving, researching, verifying, or acting upon a matter outside the agreed scope merely because information was mentioned during communications.
19. No Legal Representation
Blue Dog Investigations does not act as legal counsel.
Investigators may document facts, obtain information, conduct research, preserve evidence, interview individuals, conduct surveillance, and provide litigation support within lawful authority, but legal conclusions and legal strategy remain matters for qualified counsel.
20. Controlling Agreement
This Disclaimer supplements, but does not replace, the written investigative services agreement applicable to an accepted assignment.
Where an executed engagement agreement contains more specific provisions, that agreement controls the engagement to the extent permitted by applicable law.
